These Terms of Use (“Terms”) govern access to and use of the Gen One Futures website, applications, dashboards, and related services (collectively, the “Services”) operated by Gen One Futures (“Gen One Futures,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms.
1. Important Summary
Gen One Futures provides a simulated trading evaluation environment using virtual funds for educational and performance-assessment purposes. No real funds are traded, and no live market orders are executed through our Services.
2. Eligibility
You must be at least 18 years old (or the age of majority where you live, whichever is higher) and able to form a binding contract. You are responsible for ensuring your use of the Services is legal in your jurisdiction.
3. No Brokerage, No Investment Advice
We do not provide investment advice, trading recommendations, brokerage services, or execution services. We are not registered as a broker-dealer, futures commission merchant (FCM), introducing broker (IB), commodity trading advisor (CTA), or commodity pool operator (CPO).
Nothing on the Services should be interpreted as financial advice.
4. Simulated Nature of the Program
All trading activity, performance metrics, rules testing, and evaluations occur in a simulated environment with virtual funds. Performance results may differ from live trading outcomes and may not reflect real-world conditions (including liquidity constraints, latency, or execution differences).
5. Accounts, Access, and Security
You agree to:
Provide accurate account information.
Keep login credentials confidential.
Notify us immediately of unauthorized access.
You are responsible for all activity under your account.
6. Fees and Payments
If the Services involve fees (evaluation fees, subscriptions, resets, add-ons), you agree to pay all applicable amounts disclosed at checkout. Taxes may apply.
7. Rewards, Payouts, and Eligibility
If the Services offer rewards or payout opportunities:
Rewards are based on simulated performance and subject to rules, eligibility requirements, and compliance review.
We may require identity verification and tax documentation where applicable.
Rewards may be delayed, withheld, or denied if we determine violations of these Terms, program rules, fraud, abuse, or prohibited conduct.
(Competitors explicitly frame payouts as discretionary/conditional. Keep yours tight and enforceable.)
8. Prohibited Conduct
You may not:
Exploit or attempt to manipulate the simulated environment, metrics, or rules.
Use automation, scripts, bots, or tools to gain an unfair advantage unless explicitly permitted in writing.
Share, sell, transfer, or sublicense accounts.
Engage in fraud, chargeback abuse, identity misrepresentation, or payment manipulation.
Interfere with the Services (including load testing, scraping, reverse engineering, or security probing).
We may, in our discretion, take action including deleting simulated trading days/results, resetting accounts, suspending access, or terminating accounts for prohibited conduct or rule violations.
9. Market Data and Third-Party Services
Market data, charts, and related information may be provided by third parties. We do not guarantee data accuracy, completeness, or availability, and we are not responsible for errors, omissions, or outages in third-party data.
10. System Risk
Electronic trading systems and web services may experience delays, outages, or failures. Access times and performance may vary due to volumes, market conditions, and system performance.
11. Intellectual Property
All content, branding, designs, text, code, and software are owned by Gen One Futures or its licensors and protected by intellectual property laws. You receive a limited, revocable, non-transferable license to use the Services for personal, lawful purposes only.
12. User Content
If you submit content (feedback, messages, reviews, community posts), you grant us a worldwide, royalty-free license to use it to operate and improve the Services. You represent you have rights to submit it.
13. Termination
We may suspend or terminate your access at any time for violations, risk, security concerns, or suspected abuse. You may stop using the Services at any time.
14. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
15. Limitation of Liability
To the maximum extent permitted by law, Gen One Futures will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill.
16. Indemnification
You agree to defend and indemnify Gen One Futures from claims arising out of your use of the Services, your violation of these Terms, or your violation of any law or third-party rights.
17. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Exclusive venue for disputes will be [County], Florida, unless otherwise required by applicable law.
18. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after changes means you accept the updated Terms.
